The combination of travel services offered to you constitutes an organized trip within the meaning of Decree-Law No. 17/2018 of March 8.
Therefore, you will benefit from all EU rights applicable to organized trips. Atlantida DMC, Lda. will be fully responsible for the correct execution of the entire organized trip.
In addition, as required by law, Atlantida DMC, Lda. has protection to refund payments you have made and, if transport is included in the organized trip, ensure your repatriation if it is declared insolvent.
Essential rights provided for in Decree-Law No. 17/2018 of March 8:
• Travelers will receive all essential information about the organized trip before entering into the respective contract.
• There is always at least one operator responsible for the correct execution of all travel services included in the contract.
• Travelers have an emergency telephone number or contact details of a contact point to be able to communicate with the organizer or travel agency.
• Travelers can transfer the organized trip to another person, with reasonable notice and, possibly, upon payment of additional costs.
• The price of the organized trip can only be increased in case of increase in specific costs (for example, fuel price), if this possibility is expressly provided for in the contract and, in any case, up to 20 days before the start of the organized trip. If the price increase exceeds 8% of the organized trip price, the traveler can terminate the contract. If the organizer reserves the right to increase the price, the traveler has the right to a price reduction in case of reduction of relevant costs.
• Travelers can terminate the contract without paying a termination fee and obtain full refund of payments made in case of significant change to any of the essential elements of the organized trip, except for price. If, before the start of the organized trip, the operator responsible for it cancels it, travelers have the right to refund and, if applicable, compensation.
• Travelers can terminate the contract without paying a termination fee before the start of the organized trip, in exceptional circumstances, for example in case of serious security problems at the destination likely to affect the organized trip.
• In addition, travelers can terminate the contract at any time before the start of the organized trip upon payment of an adequate and justifiable termination fee.
• If, after the start of the organized trip, it is not possible to provide significant elements of it as agreed, adequate alternatives must be proposed to the traveler, without additional costs. The traveler can terminate the organized trip contract without paying a termination fee if the services are not performed under the terms of the contract, this lack of conformity considerably affects the execution of the organized trip and the organizer does not remedy this lack.
• Travelers also have the right to a price reduction and/or compensation for damages in case of non-compliance or poor execution of travel services.
• The organizer must provide assistance if a traveler is in difficulties.
• If the organizer or retailer is declared insolvent, payments will be refunded. If the organizer or retailer is declared insolvent after the start of the organized trip and if transport is included in the organized trip, repatriation of travelers is guaranteed.
